By using our app, you are choosing to explore ancestry and heritage through AI-powered analysis. Our intent is to provide educational and entertaining insights, not to make definitive claims about your genetic background or identity.

These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and XYK LLC, a company registered in Seattle, Washington, United States of America ("Company", "we", "us", "our").

We operate the mobile application AncestryScan ("App") and related services that refer or link to these Terms (collectively, the "Services").

BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.

1. Services Overview

The App provides ancestry and heritage exploration services using facial analysis, phenotype classification, and name-origin intelligence powered by artificial intelligence and machine learning algorithms. Our Services include:

1.2 Purpose and Intended Use

The Services are designed for:

• Tracking and revisiting your ancestry scan results over time

1.3 Service Limitations

• Results are generated by automated systems and algorithms

• Services are not medical, diagnostic, or therapeutic tools
• Results do not determine personal worth, attractiveness, or value

2. Eligibility and Account Registration

2.1 Age Requirements

You must be at least 17 years old to use the Services. Users under 18 must have parental consent. By using the Services, you represent and warrant that:

• You meet the minimum age requirement
• You have the legal capacity to enter into binding agreements
• All information provided is accurate and complete

2.2 Account Creation

You agree to use the Services responsibly and understand that:

• The Services should not be used to make legal, medical, or identity-related decisions

4. Genetic and Ancestry Disclaimers

IMPORTANT: THE SERVICES ARE NOT GENETIC TESTS, DNA ANALYSIS TOOLS, OR SOURCES OF SCIENTIFIC OR LEGAL EVIDENCE.

The Services do not:

• Provide genetic or DNA analysis
• Offer definitive proof of ancestry or ethnicity
• Replace professional genetic testing services
• Provide legal documentation of heritage or identity
• Determine citizenship, immigration status, or ethnic classification

4.2 Educational and Entertainment Purpose

The Services are designed for:

• Entertainment and personal interest
• Learning about regions, cultures, and name origins
• Understanding phenotype classifications as anthropological concepts

Results should not be used for:

• Legal or official documentation

Results and confidence scores are estimates generated by automated systems and are intended for educational and entertainment purposes only. They are not definitive measures of identity, ethnicity, genetic makeup, or personal worth.

The app is meant to empower curiosity and learning about ancestry, regions, and cultural heritage. Safeguards are in place to avoid harmful outputs and to encourage a healthy, balanced understanding of ancestry and identity.

5. Privacy and Data Protection

• Subscriptions automatically renew unless canceled
• Cancellation must occur at least 24 hours before renewal
• Refunds are subject to our refund policy and applicable platform policies
• Subscription benefits are non-transferable

8.3 Free Trials

• Trial terms will be specified during signup
• Trials automatically convert to paid subscriptions unless canceled
• One trial per user/household

• Payments are processed through Apple App Store, Google Play Store, or other authorized platforms

10. Mobile Application License

13. Term and Termination

WE MAKE NO WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF:

• AI-generated content or insights
• Third-party integrations or data
• User-generated content

14.3 Fitness for Purpose

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• TITLE OR QUIET ENJOYMENT

15. Limitation of Liability

15.1 General Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
• EMOTIONAL DISTRESS OR MENTAL ANGUISH
• PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM SERVICE USE

15.2 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE OF ACTION SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

16. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your user-generated content
• Your negligent or wrongful conduct

17. Dispute Resolution

17.1 Informal Resolution

Before filing any legal action, you agree to first attempt to resolve disputes informally by contacting us at support@ancestryscan.app with a detailed description of the dispute.

17.2 Class Action Waiver

YOU AGREE THAT DISPUTES MUST BE BROUGHT INDIVIDUALLY AND NOT AS PART OF A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

18. Governing Law

These Terms and your use of the Services are governed by the laws of the State of Washington, United States, without regard to conflict of law principles.

19. Miscellaneous

19.1 Entire Agreement

These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and us regarding the Services.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
